If a law is clearly unConstitutional, you SHOULD not obey it. You are not obliged to obey an unconstitutional statute or edict of a court, no matter what the judge says. However, you may wind up paying the penalty or spending time in jail. This is the trappings of Tyranny and the small little steps of oppression creeping into our society.

exactly...I mentioned this to someone from my church today..

when she took the oath of her office she swore to fulfill faithfully the laws pertaining to that office as they were written then...

She hasn’t broken any law..

CAPITAL LETTERS make you important.

Either practice civil disobedience because you feel a law is unjust and pay the price, or change the law. As someone suggested, if the state just got out of the marriage license business, there would be nothing to give out. Otherwise, ignore federal law at your own peril, as many have done in the past.

Well, folks. A Christian has been put in JAIL!!!

In our lifetimes, for her religious beliefs.

The Federal government doesn’t follow immigration law. Put obunmmer in jail.

I hope Trump goes insane over this. Not because he is the only one, because he gets the most attention. Here’s his chance to REALLY prove what he is.

I’ll join any protest and will try to start one on my own on Staten Island.

THEY HAVE CROSSED THE LINE!!!

She broke an unconstitutional law.
The judge denied her, her first amendment rights.
The law is clear and the judge is in the wrong.
Unfortunately she is being railroaded by a misguided judge.

Five Justices on the Supreme Court have overturned the votes of 50 million Americans and demanded that the American people walk away from millennia of history and the reality of human nature.

In reaching a decision so lacking in foundation in the text of the Constitution, in our history, and in our traditions, the Court has done serious damage to its own legitimacy.

Brian Brown of the National Organization for Marriage adds:

We urge the American people and future presidents to regard today’s decision just as President Abraham Lincoln regarded the Dred Scott ruling when he said in his first inaugural address that “if the policy of the government upon vital questions, affecting the whole people, is to be irrevocably fixed by decisions of the Supreme Court, the instant they are made…the people will have ceased to be their own rulers, having to that extent practically resigned their government into the hands of that eminent tribunal.”

So IMHO it sounds wishy washy, you can do this either way...

The Supreme Court decides if a ‘law’ is a ‘law’ but can’t make a law unless voted upon by the citizens...have we done that? Has there ever been a vote on this as a nation or has there ever been a vote by each state?

She did not break any laws. She refused to obey an unconstitutional court order. She obeyed the law. Kentucky law does not allow a county clerk to issue a marriage license to a same sex couple. The Supreme Court may have voided the law in its opinion, but if the law is void, then the clerk had no authority to issue any marriage licenses at all. There is no law authorizing her to do so. There is, however, a law prohibiting her from doing so.

I commented on Trump’s website: Take a stand one way or the other. A Christian is in JAIL even though states right were mowed over by the Courts.

I repeat again, a Christian is in JAIL because of her religious beliefs.

It’s fun commenting on the board and God knows letting my anger at libs feels great, but this demands MORE.

Protests in every state.

Take a day off if you have to. I will. This is BAD

Judges have civil immunity for their actions as judges, so suing the judge will accomplish nothing.

Where is the local sheriff, and why did he allow her to be taken into custody?

If this is the way it is then all these lawyers out there, the judge who ordered her to the clink, who btw is a Republican, what of them?

I can prove she broke no law.

She is not in jail for breaking the law. She is being held on CONTEMPT OF COURT.

If she had broken the law , then they could have charged her with a crime.

They can’t, they haven’t.

Sorry bigbob, but there is no federal law that she could have broken.

She was enforcing Kentucky law.

Only the State of Kentucky has the authority to legislate on marriage in Kentucky.

She has committed no civil disobedience, since she was acting under the only authority that exists in that state.

If you are pro gay marriage, as your post seems to indicate, you’re headed for the big zot here.

True.

A federal judge tried to order her to disregard state law on marriage. She told him no. He charged her with contempt of court and had her taken into custody.

She did not commit a crime, She has not been charged with a crime.

She is being held because she said no to a federal judge for completely legal reasons.
