A suspected burglar who attempted to enter a California home through the chimney died on Saturday after the homeowner lit a fire without realizing anyone was inside, police said.
The man appeared to have climbed into the chimney during the night while the owner was away and then became stuck, according to the Fresno County Sheriff's Office.

The homeowner should be retaining an attorney.
Moral: Whenever you light your fireplace, check for obstructions. Otherwise the fire department will dismantle your chimney, causing significant damage to your property.
Its not the first time this has occurred, there aren’t enough Darwin awards to go around for this one.

Yes, this happened in California. The homeowner could be charged with negligent homicide for not making sure there was no one in the chimney before lighting the fire.

I am sure you agree with me, but is’nt this a sad commentary on the world in which we live? Stop and think about it - a guy (unbeknownst to you) tries to break into your home through the chimney. You light a fire (again not knowing someone is trespassing) and your house fills with smoke as Joe Felon is yelling from the chimney. You try to put out the fire (seriously - hard to imagine what the heck you are thinking at this point) as your house fills with smoke and you call the fire department who comes and destroys your chimney to rescue Joe Felon.
And you might get sued........
All the proof we need that there are too many lawyers in America!

As far as the would-be burglar goes, tough titty, "workplace misfortune".
One would think that if you were going to break into a house, an easier path could be picked..... Sheesh, even if one got to the firebox, you would be a mess in soot, have dead from inhaling the dust and with no guarantee that you can physically get from the firebox into the living space.
The write-up by the insurance agent should be interesting.
Of course he used kindling to light the fire. A bush, in fact.
