Dad allegedly stole the phone, which apparently belonged to Mom.

So we are to assume that the daughter was renting it? That the daughter borrowed it?
No. Mom is lying. The phone belonged to her until she GAVE it to the daughter, thereby transferring ownership and likewise putting it under the control of the daughter's custodial parent.
