No, Uber sets the rates based on mileage and actual traffic conditions. The rates automatically increase during peak times.

The driver has the choice of accepting or declining a job however.

If the pay is indeed too low, there will be too few drivers for good service and rates will have to increase. Right now, I’ve never had to wait more than 5 minutes for an Uber (in NYC)

Exactly right. Nobody is forced to work for Uber.
