This teen was swinging a baseball bat at the officer who shot the kid but the bullet passed through him and killed a woman in the same apartment building. The woman’s family has a strong case against the city.
A case, yes. But not necessarily a strong one:
Grandma in an unlighted, or dimly lighted, or even a well-lighted hallway, standing to the rear of the bat-wielding
subject, may not have been visible...and, likely, was notvisible, to the officer who perceived an immediate life-threat directly in front of himself. An examination of facts at Grand Jury or Coroner’s Inquest will determine the reasonableness of the officer’s actions. The physical evidence does not lie.
