SCOTUS ruled on this in the NLRB case that Obama lost. As long as the Senate stays in session like it did to stop NLRB appointments like Obama made anyway, they are void.
The Senate decides when it is in recess. Not our Imam in Chief or any real President either.
I don’t think anyone has ever made a recess appointment to the Supreme Court. Has anyone ever made one to a lesser court?
