Nope. By your own statement, the Constitution at the time included the power to amend the Constitution. So, as long as the replacement Amendment were passed according to the proscription for the amendment process, the answer is no.

Wouldn’t a replacement amendment be a pretty big infringement? The 2nd doesn’t allow for compromise.
