Is there a law against opening a beer in front of an officer? If so, the legislators responsible for that absolutely need to go.

Saw a guy in front of me driving erractically and swerving all over the road from urb to curb. Called 911, thinking he was past sleepy or drugged or having a seizure.
He finally pulled into a parking lot, opened the door, and literally rolled out of the seat and onto the pavement. Then got up and staggered towards the liquor store.
Then the cops showed up. Ends up that I was the only person who swear that he “was driving drunk” ... Nobody else could provide evidence he (1) was drunk, (2) was driving and (3) was doing both at the same time.
Seems like his lawyer was going to use a defense of “the cops couldn’t prove he was driving drunk” because they only “found him laying on the pavement drunk”. Not in the car while it was moving.
She must’ve been on her way to vote for Paul Ryan.

In the drivers drunken mindset, maybe she figured she was busted so why not chug one and then try and claim the only drink she had was ‘after’ being stopped so she was never actually drunk ‘while driving’.
Of course that makes little sense, but she was drunk after all. LOL.
We pulled up on a loaded concrete truck that turned over while making a turn. The driver is standing on the door and we can see him through the windshield chugging a beer. He was drunk enough to not injure himself but was rewarded with a DUI after we got him out.
Some hours later we had the road cleaned up.

Cracking open a cold one, while “the man” is on you. That takes balls.
Key in the ignition is the rule in most states. Just being in the car, it could be a spare, negating intent. If in your pocket, you could have grabbed them by mistake instead of your house keys. Beyond a reasonable doubt cannot be established without the keys in the ignition proving intent. (A mistake a lot of folks do is pulling over to sleep it off and leave the keys in the ignition to listen to the radio, Busted!, even with no intent to drive.
Drinking after getting pulled over has beaten many DUI charges but it is usually with liquor, not beer. It is difficult to extrapolate blood alcohol content before the perp gets stopped if the perp is drinking liquor after and alleges he/she had none or only beer before. “I was nervous and scared. Police scare me, so I opened the bottle and started chugging to calm my nerves.”
When they have to bring in crisis counselors because someone wrote “Trump 2016” in chalk, everything is predicated on emotional immaturity and ineptitude.
