FULL TITLE: Parents sue school district after their severely bullied 13-year-old daughter hanged herself and left behind note 'apologizing for being ugly'

The parents of a 13-year-old girl who committed suicide in November after being bullied for two years are suing her school district over a wrongful death claim.

Rosalie Avila, 13, hanged herself inside her family's Yucaipa, California home on November 28 and was later declared brain dead before being taken off life support December 4.

Her parents, Freddie and Charlene Avila, allege that their eighth-grade daughter was relentlessly bullied at Mesa View Middle School by fellow classmates who taunted her by saying 'she had ugly teeth, that she was ugly, a whore, a slut, and had sexually transmitted diseases,' according to a news release, KTLA reported.

The teen's classmates allegedly circulated a video showing what an ugly girl looked like and what a pretty girl looked like and used a picture of Rosalie to portray the ugly girl,' the release stated.

'In her suicide note, she apologized to her parents for being ugly.'

Weeks after her tragic death, the alleged bullies still targeted her on social media, according to her parents. One recent post read, 'Rosie is still annoying me from the grave.'

Her parents were also subjected to cruel bullying comments and messages.

One person sent them a message with a meme that said 'hey mom,' next to a picture of Rosalie's face.

Very true....but the parents also had other options as well...It’s like people that think they’ll just call the police when their house is being broken into....you better have ‘options’ before they get there.

Obvious they didn’t want to go further than ‘reporting’ it to the school. That’s like reporting to Congress of corruption.....’talk’ is cheap and easily brushed aside.

Yes indeed.....one kid took a baseball bat on the bus and threatened the bully with it....bully reported it and the kid got a home visit from the school Counselor for bullying the bully....imagine that!..... That’s when the parents took over and put the fear of God in the punk... It was a beautiful thing to see the punk cower along side the road. They didn’t touch him but told him his parents would be picking him off the road if there was a next time.. and if he even breathed a word that they had cornered him.

This is a tragedy, bordering on the criminal.

Middle-school/Junior high is the most brutal two or three years of school. Kids are are crazy with hormones and social pressures and often turn into ruthless and cruel jerks. I'm of the opinion that most traumas and insecurities of the average person's lives come from their middle-school years. If you ever have a mind to homeschool your kids, the middle-school years would be the time to do it.

I am a retired 25 year private school teacher where bullying was more or less not
allowed/dealt with.

This past semester I have substituted in a govt middle school, and I see why I think
bullying happens: the punks are not disciplined because they are too tough to deal with.
They are appeased to keep peace. The ones bullied are meek and don't cause the turmoil
that the punks do when severely disciplined. And so it continues.

I like that kind of justice, where folks work together. In one instance where I stood up to a wannabee bully, we both ended up in the principle’s office. But I didn’t give a hoot, just explained to him we’d be having daily get-togethers if the wannabee kept it up. But it stopped after that.

I agree, parents can NOT let this happen. In fact, in a child’s mind, when the parents don’t act it is quite possible the child interprets this as nothing can be done because she is ugly, she does have ugly teeth, etc. and places the parents in an adversarial position along with the bullys.

Nope....not anymore...Their hands are tied by leftist laws... concerned parents understand this. Especially in this case that went on ‘for two years’, why the parents didn’t carry on with other options to protect their daughter is highly questionable.

By the time a kid actually tells the parents they’ve usually already been bullied for a considerable time. Further teachers ‘KNOW’ who the bullies are. Unfortunately the bullies parents are often bullies themselves.

In this case the police should have been brought in..and depending on what the states laws are against bullying the parents would know what to do in that regard.

But Imo the best avenue is to go right to the bully with other parents. Get him/her alone and put the fear of God in them.....works every time!

This story was told to me, well our class in the mid 80’s by a teacher.

There was a boy who was bullied in some school, don’t know which one. He told either the principal or VP and that man just laughed at him. The next day he brought a shotgun the school. The principal asked “what the hell are you doing?” and the boy not only blew him away but the bully too.

Now this story was told to be around 83 or 84 so when did it happen? Point being, this been going on a long time and schools being nothing a long time.

The time to sue is when the school isn’t addressing the issue......and further get the police involved directly with the parents of the bullying. ....there was nothing preventing the parents from pulling their child out of this school for her own safety. So why sue now? Obvious it is.”

Dare I say it? They probably immigrants who could not speak/write English and had no choice but to keep her in public school to learn it?

I could not agree more. 7th and 8th grade were absolute hell for me. They were the worst years of my life, for all these reasons.

We homeschooled our kids into their teen years and when we moved to a very SMALL school district, we gave them the option to go to the local HS or not.

They chose the latter, but I swore I would not put them in public school before they got done with 8th grade. I would not inflict that on my kids.

By the time they got into high school, they knew how to very effectively deal with bullies and after my son dumped one in a snow bank and my daughter incapacitated one boy who would not leave her alone, NOBODY bothered them.

Also, one kid made an unfortunate comment about my daughter to her older brother (they are very close and not must in age. They have a wonderful relationship).

The kid was lucky to have survived it.

He told on my son to the coach who asked what was said. When my son told him, he told the other kid that he deserved what he got and was lucky it wasn't more.

There is still some sanity left in a few public schools.

Oh, they do. And they know who the bully parents are.

And of course, so many parents still bully school districts with threats of lawsuits.

It’s just a different kind of bullying.
