It would not violate the Outer Space Treaty signed in 1967 which prohibits nuclear, biological, or chemical weapons from being placed in or used from Earth's orbit

In 2004 It was predicted to be about 15 years away from being practical but the only issue was the cost to launch them into space

The Falcon Heavy is an extremely low cost Rocket which is a more powerful than the Delta IV Heavy, and would cost the US government about five times less.

The newer projectile was successfully Tested at Holloman Air Force Base in New Mexico 2013
