“Subpoena them. They don’t have to comply with a request but they do have to comply with a subpoena.”

They should do this. If the lawyers refuse then everyone of them should be disbarred - that is an expensive punishment.

A referral to the FBI for investigation of lying to Congress is the next appropriate step, for all of the women who made apparently false claims against Judge Kavenaugh.

Ford’s legal team cover up is deeper than the Pacific Ocean.

It came up just short of what the whole thing was designed to do. If the charge stuck, great. If not at least the thought was hammered into everyone’s head until it’s all disproved. Way before that time the vote was supposed to have failed.

I hope the Republicans are clever enough to keep bringing this to the attention of the swing Senators. There are now three weak links to be reinforced, and one to rope back in if possible. Continued bad faith from the dems should matter to all of them.

“This whole episode is wrapping up a lot faster than I expected. In two weeks, no one in the media will ever mention Professor Ford again.”

yep ... and in a year, Kavanaugh will be nothing more than a political footnote pairing him with Thomas as two who were viciously Borked, but survived confirmation anyway ...

If it was at the direction of the lawyer to aid the lawyer in legal representation of the client, the privilege may apply.

Law enforcement polygraphs are usually videotaped and audioed.
Notice how Ford who could remember only having one beer at a party 37 years ago could not remember whether her polygraph that was taken 6 weeks ago in which she was only asked 2 questions was videotaped. That is because she kept taking it until they got the “right” results

Attorney-client privilege applies only to confidential conversations between you and your lawyer. Any time there is a third party in the room or involved then that privilege no longer applies.

That simply is not 100% true. I'm a consultant in the construction industry, occasionally providing expert testimony. On some occasions, I have been hired as a consultant for the attorneys. My advice to them, both written and oral, was totally protected.

Since it was not Ford that paid for the polygraph, lets assume it was the attorneys that hired, and paid for the poligrapher as a legal consultant. I believe the results would be protected and there would be no power to subpoena the poligrapher.

Oh geez! I wonder why they would refuse to send in the paperwork from the alleged Christine Blasey Ford polygraph. Because maybe it would be ajudged to be not valid? I’ll bet!

actually, I think (at least in Florida?) that if the “expert” (i.e. polygrapher) is hired by the attorney the results of that are privileged. I know that is the way it works for CPAs doing work on divorce cases. Don’t know why this would be different - except for the fraud aspect.
