They could, but like the rest of the controversies surrounding Executive authority, it would be elevated if something this basic to the Presidency and enshrined by statute is challenged.

If both houses have to vote on this thing, that means Senate would have to override veto too (if the override part is applicable). I doubt strongly Senate would even protest about a Nat Erm for national security/border security.

Congress can go ahem itself and it appears that is what they’ve been busily doing anyway.
