I read recently that the biggest hurdle right now is imposing eminent domain on the property owners where they have to put the wall through. That’s going to be something of a red line and he has to get the courts packed just right. Come on RBG! Death Pool!
After the Kelo decision, no way.
Kelo allowed Pfizer to basically wipe out whatever they wanted to put up a for profit business, and Souter actually voted in favor of that, which sealed it.
Kelo is one of the more obvious anti-property rights, anti-4th Amendment decisions ever.
If you can take property to build a drug company in CT, building a militarily necessary bulwark to invasion is nothing in terms of eminent domain.
Remember, folks get paid for what is taken. Most farmers aren’t going to complain, believe me.
Interesting I had seen something a few months back that said the entire border was already under legislation along the lines of an easement in place throughout the US and the feds could actually do as they pleased within a certain distance of the border. I don’t recall how far though...maybe 150 ft or yards....no I don’t remember.

Just put it on the Mexico side by "eminent domain". God knows we've paid for that sliver of land over and over and over.
