State's exhibit no. 109 recoiled, and bit to defend herself, as Fulton County prosecutors staged a mild re-enactment of a puppy's final moments before being killed in a gas oven.
Rita, a 3-month-old shepherd mix serving as a stand-in, didn't have to fear she would be hog-tied with duct tape and her snout wrapped like the puppy killed at an Atlanta apartment complex. And she wasn't covered with paint or stuffed into a searing hot oven.
Still, the cute brown puppy with a black muzzle never let forensic veterinarian Melinda Merck subdue her completely. And, Rita was only playing with Merck not fighting for her life.
"That's the first thing she will do, bite," Merck said. "If I continue, she's going to start crying and crying."
Merck took the stand Tuesday in the prosecution of Justin and Joshua Moulder, two brother charged with breaking into and trashing the community center at the Englewood Manor apartments and torturing and killing a puppy.
Testimony is expected to wrap up tomorrow, completing a case that began testimony last week.
Merck's presentation to the jury provided both levity and horror. Even deputies laughed as Rita licked her captors and yawned and played, unaware of the grave reasons for her appearance.
The two shots Merck showed before testimony wrapped at 5:30 p.m. were barely recognizable - the puppy's body doused in paint and still wrapped in duct tape. She also gave gripping testimony of the puppy's struggles inside the burning oven.
"The claws were bloody," she testified of the dog's futile attempts to claw its way from the oven. "They had been worn down. Every exposed claw was worn down and bloodied."
Some jurors rocked forward in their seats. Others looked away. The two

Tearfully, Chamblee
Today was the 3rd straight day in a row for me at the trial for the 2 monsters that baked the puppy. Another day at the Fulton County Courthouse.
On August 21, 2006, 2 brothers broke into a >newly renovated community center and destroyed it. They threw paint all >over, busted all the glass windows, threw the computers out the window, and >did thousands of dollars worth of damage. But they were not finished yet. >Going into the community center with them, was a 3-5 month old little puppy >that followed them everywhere. She was sweet and adorable. Several witnesses >saw her follow them. >First the monsters painted her with paint. Then they picked her up and put >her on the counter next to the new oven. A small amount of urine was found >there. The vet said she was afraid and urinated submissively. Next she was >"hogtied". Her front legs were taped together with duck tape as well as her >back legs. Then her mouth was taped together, but not her nose. She was >alive and breathing when the monsters (Jason and Joshua) put her into the >oven they had set at 500 degrees. The forensic veterinarian said her vagina >might have been burned prior to being put into the oven. >According to the veterinarian, she struggled, and struggled, screamed, >cried, defecated, and scratched the inside of the oven door until her nails >were gone and only blood and nerve remained. >Blood covered the oven, but in a particular pattern because these monsters >had tied her neck to the rack of the oven. >There were pictures of every detail. She did not die fast. The forensic vet >said she was cooked from the inside out. That she did not just die of smoke >or heat. She died of "thermal heat" or some term that included thermal, and >meant her entire body was cooked. >Later that day, Jason and Joshua took each of their friends into the center >to see the dead dog in the oven. Each friend was told they would be killed >if they told anyone. >Jason and Joshua then ran to their sisters apartment within the community, >packed their backpack with the evidence and were on their way out when the >police arrived. >Six or seven children testified against Jason and Joshua, stated they were >the 2 who cooked the puppy. The defense attorneys said the children lied. > Adults testified, specialists testified, and even a "duck tape" >specialist testified that the tape in the monsters' backpack matched the >tape taken off the charred body of the puppy. >The brothers' fingerprints had melted at the high heat in the oven, >although paint, duck tape, and every other item known to man, connected >these monsters to the crime. >The jurors start their deliberation tomorrow morning. > >After being allowed back into the courtroom today, I tried not to look at >the pictures of the puppy's body lying in the oven. I stared at the >medallion over the judge's head which read: "Center of Justice 1776". >Justice. What exactly does that mean for this puppy? Even if Jason and >Joshua got the maximum penalty, would that be justice? > >The DA had asked us to go visit the Governor to show our support for the >prosecution. We did, but Perdue was out of town. Would Governor Perdue help >us with the "anti-dog fighting" bill this year? Who knows. Would Perdue >care or do anything about the puppy being baked alive? Will you? > >Will Jason and Joshua get what they deserve? I don't know. I was told that >most people don't want to hear about what happened. That an email about it >might not be in good taste. >I do know that if the puppy had to live through the worst pain and torture >imaginable, the very least we can do is be aware of what happened to her >and make sure it doesn't happen again. > >Jason and Joshua were dressed in suits and being treated very well. Jason >had a cold and every time he sneezed his lawyer consoled him. >How civilized we humans are, and thank God for proper etiquette. >And what about JUSTICE? What does justice mean to you? > I am beyond mad. I hope this email makes you mad. Call your representative-call Sonny Perdue-call the media, and ask for stronger animal cruelty laws.
These two will do that or something as cruel to a human one day.
Possibly not in this life, but certainly eventually.
This makes me so sick. I love my dogs so much, I can't imagine anyone doing that to an animal.
Justin and Joshua Moulder

What makes you think that they have not already? Pure evil. I hope they leave this earth painfully and soon.
Nothing compared to the horrors of an abortion.
But America doesn't want to hear that.
The DA in Atlanta has received many emails and letters and I believe phone calls from all over...I think this will make a difference...there two need to be punished to the fullest extent..
Sympathy for your friend. There is no way I could sit on this jury and not scream at these two monsters.
I hope those two bastrad get raped and beaten to death in jail.
I think that's a safe bet.
I wonder how much these two little bastards would like to be hog-tied with duct tape and have paint poured on them and THEN stuffed in an oven?!
Animal abuse horrifies me - and makes me angry. I don't consider myself a violent man but I guarantee if I ever got ahold of these two dirtbags, I'd break their kneecaps - and then tell 'em why.
These two deserve DEATH. I know puppies are not humans, but the capacity for cruelty shown here should be a warning.
Glad I'm not on that jury. Whatever the maximum was, I'd be a hold-out for it. These two should be duct taped and put in an oven
Damn, my day was going pretty good until I read this.
Not your fault. I should not have read it.
BTW, the puppy used in the trial demo was adopted...right after the demo.
That is nice.
How old are they? That's just a head shot, but they look like teens.
Joshua Moulder, 17, and Justin Moulder, 18.
Sorry, I don't mean to be morbid, but at 500 degrees, assuming the paint is flammable, wouldn't the puppy catch on fire and burn to death first, before "cooking"?
They will be doing it in prison, because that is where these monsters are going.
What's really sad is that the jury reported to the judge that they were deadlocked on some of the charges. I guess some of the jurors must find this behavior aceeptable--but then again, this is in Atlanta.
