Canadian-born Ted Cruz says “facts are clear” he’s eligible to be president
http://trailblazersblog.dallasnews.com ^ | 07/21/2013

Posted on 07/21/2013 9:20:29 AM PDT by Ira_Louvin

Sen. Ted Cruz rejected questions Sunday over his eligibility to be president, saying that although he was born in Canada “the facts are clear” that he’s a U.S. citizen. “My mother was born in Wilmington, Delaware. She’s a U.S. citizen, so I’m a U.S. citizen by birth,” Cruz told ABC. “I’m not going to engage in a legal debate.” The Texas senator was born in Calgary, where his mother and father were working in the oil business. His father, Rafael Cruz, left Cuba in the 1950s to study at the University of Texas and subsequently became a naturalized citizen.

President Obama has been hounded by critics who contend he was born outside the U.S. and, therefore, ineligible to win the White House. Obama was born in Hawaii. But some Democratic critics have taken the same charge against Obama by so-called “birthers” and turned it against Cruz. The Supreme Court has not definitively ruled on presidential eligibility requirements. But a congressional study concludes that the constitutional requirement that a president be “a natural born citizen” includes those born abroad of one citizen parent who has met U.S. residency requirements.

“I can tell you where I was born and who my parents were. And then as a legal matter, others can worry about that. I’m not going to engage,” Cruz said in the interview with “This Week” on ABC.

If the 2016 election was to be held today, Hillary Clinton would defeat any prospective Republican candidate. http://www.pollingreport.com/2016.htm

That poll is meaningless because the people being polled only hear a name that everyone has told them is "Wonderful"!

In a real election campaign, the Republicans could easily destroy her with withering fire, even if they could not depend on the media to report on the ugly scandals in her history. Now a legitimate question would be whether or not they would actually do so, because they've pretty much shown themselves to be a bunch of P**sies when it comes to putting up a fight.

Hillary could only win an election if the Republicans don't put up a fight. If they do, it's over for her. She is an ugly screeching harpy that inspires no love or confidence in anybody except her Democrat Media cult club. They wouldn't be able to save her unless the Republicans simply don't fight.

Very astute and accurate observation. The notion that the common law was universal, and universally adopted, is simply wrong. Especially when it conflicted with well known and well understood AMERICAN principles.

Your quote from the March 6, 1790 Act is incorrect.

“and John Sockman, ...immunities of natural born subjects.”
is how the top of page 510 reads on the link you provided.

Was there a reason that you changed it?

Rawle's personal history does not address the point that HIS interpretation directly contradicts that of Chief Justice of the Supreme Court John Marshall, and that of Associate Justice Bushrod Washington

and George Tucker, who had already annotated Blackstone's Commentaries.... a work which so impressed President James Madison that he appointed Tucker to the Virgina Court.

Since you like dropping names, Jeff.

It's not the first time you've read him the riot act for misconstruing Bingham , either, DiogenesLamp.

There was no intentional change on my part. The word subject and citizen seemed interchangeable to them. Maybe it was habit since they'd all been 'subjects' since birth.

Jeff posted a few examples HERE , but they are unsourced.

I do try to find old works, not recently published rehashes filled with contemporary interpretations. The one I posted is pretty much the oldest I've found. So far anyway.

I will add, though, that this plan doesn't seem to have been entirely set in stone. I think Rawle did at least consider the possibility of staying in England and becoming a lawyer there if the opportunities were better in England.

The point you miss about Rawle, was that while he was away in England studying Blackstone, etc. The Rest of America was studying Vattel. Rawle MISSED that most important period when the ideas of Vattel were Dominating America.

United States Supreme Court:
UNITED STATES STEEL CORPORATION et al., Appellants, v. MULTISTATE TAX COMMISSION et al.

Argued: Oct. 11, 1977.

Decided: Feb. 21, 1978.

The international jurist most widely cited in the first 50 years after the Revolution was Emmerich de Vattel.

Rawle Missed the Vattel lessons.

Okay found another that is a bit older and says Citizen

November 22, 1788
……andPhillip Theobald & John de Polerisky, upon taking the oath of allegiance to this Commonwealth before two Justices of the Peace, & paying to the Secretary the fee in such case required, shall be deemed adjuded and taken to be free Citizens of this Commonwealth, and entitled to all the liberties, priviledges and immunities of natural born Citizens.

Acts and Resolves of Acts and Resolves Passed by the General Court of Massachusetts

I've fixed the wordage in my files. Thanks for bringing that to my attention, BTW.

Oh, and Jeff, That English Common law thing is not so cut and dried as you might think. According to THIS AUTHORITY, The Children of Foreigners born in England were NOT "natural born subjects" they were "Denizens." It explicitly says so.

From this book. (1726)

The Author "Giles Jacob" was quite the publisher of legal books.

That’s the way millions of Americans vote, on name recognition only.
Hillary Clinton has finished first in Gallup’s annual “Most Admired Woman” poll seventeen times. She finished first again in 2012.

Yes, I agree that Hillary Clinton CAN be defeated, if she decides to run. No presidential candidate is a shoo-in.

Barack Obama SHOULD have been easily defeated for reelection by “withering fire,” but it didn’t happen.

Neither one had a message like the Gipper did. RR got the crossover vote big time. McCain and Romney were Donk lite.

Absolutely agree.

I was in the coal business when Jimmah Cahtah was issued out of the White House. I can’t tell you how relieved we were.

Jimmy Carter was horrible. I was ashamed to be an American when he was President. Everything he did made me feel like our nation was stupid, weak and enfeebled. He went from one disaster to another, and I blame him for all deaths which occur as a result of the rise of the Iranian Mullahs to power.

Now we have the son Jimmah never had.

I never thought I would see the day that we could have a President WORSE than Jimmy Carter. This guy is not only worse, he's Jimmy Carter Squared! And without the charm!

Remember when America had a REAL President?

Thanks for posting that. I used to have a copy and link for that, but I forgot where I put it. Jeff is always going on about how we have no evidence, H3ll, we've got so much evidence I can't even keep track of it all!

Yes, it explicitly puts the kibosh on the "Anchor Baby" argument, and it's from the NEW YORK TIMES, as well!

Jeff will ignore it, or dispute it, or anything but acknowledge it as a piece of evidence which he keeps saying we don't have. Anyways, thanks for posting it.

“Rawle Missed the Vattel lessons.”

But what about all the newly trained lawyers from William and Mary?

“Wythe began teaching law at the College in January 1780. His students learned the nuances of the English common law, relying in significant measure on Blackstone’s Commentaries. Wythe also had his students read the work of contemporary political theorists, such as Montesquieu, and classical writers such as Horace and Virgil.”

Dr. John C. Eastman, Dean of Chapman University’s law school in Orange, California, is among the leading scholars in the nation on constitutional law and has testified before Congress on the issue of birthright citizenship.

I forgot about him. There's another one of those "Legal Authorities" which Jeff keeps repeating we don't have, even though he's been shown that he is wrong over and over and over again.

If I were Jeff, which i'm not, and I were CRAZY, which i'm not, I would put Eastman's name into a MASSIVE WALL OF TEXT with which to SPAM anyone who disagrees with me, which I won't.

If the Republicans don't nominate a good conservitive like a Ted Cruz or a Rick Perry..etc and the GOPE jam another "moderate" down our throats SHE will be the next president!

If she can win the election, we are doomed anyway. What would be wrong with our country could not possibly be fixed by a President.

I think we can torpedo this bitch with Benghazi alone.

Cruz is already considered one of the brightest legal minds in the country. If he has gone on record of saying he is eligible, I would wager a 90% chance he is right.
