Article 1, Section 8 of the Constitution does not give congress any power to legislate about food or drugs. That is a State police power, and rightfully belongs at the State level.
FDA and congress can pound sand.

Q. If they are THAT bad, why are they still sold to the public?
A. Tax money.

To: Dalberg-Acton
Because the federal government has no constitutional power to ban them. Just like it didn't have any constitutional power to ban alcohol.

They’re not just for smoking.

Actually, they DID have the power to ban alcohol, by Amendment to the US Constitution.
The fact that they couldn’t enforce it was the prime driver in the rescission of that Amendment.

But without the amendment, no power. The federal government needs to put back in its constitutional box.

Actually the ban was on the manufacture and sale of alcohol, not the consumption. A moot point but one that kept a lot of thirsty citizens, my folks included, out of the graybar hotels.

Good point. No constitutional authority. Good thing Obama is going to pardon all of those drug offenders

Feds shouldn't be involved in police matters anyway. That power is reserved to the States. So, yes, it's good that they are getting pardoned, but bad that they weren't jailed by their States to start with, as is constitutional.
Situational ethics need not apply. If it's wrong, it's wrong.

Theres gotta be a Lewinsky joke in there, SOMEWHERE! Slick Willie's cigar dipped into Monica's Humidor was risky as well as frisky.

Couldn’t agree with you more on that score, sir.
The Enumerated Powers have been ignored for over a hundred years. That should be one of the primary guides in a CoS, IMO.
Stay FRee.

The F.D.A should be packed up and sent to Germany and every one with a little Hitler s.o.b under each arm.

That is a State police power, and rightfully belongs at the State level. Everyone would be happier if counties had more power than the state or federal level. Counties now have more people than the original states did. Conservatives want less government and leftists want more. Each could have their wish because leftists are highly concentrated in the big city counties. Most political conflict comes from leftists trying to impose their big gov lifestyle on those outside their county lines.
