You are correct. When looking that up I came across this:

This is pretty funny too: The popular belief in the 1920s and 30s was that illegal gambling earnings were not taxable income. However, the 1927 Sullivan ruling claimed that illegal profits were in fact taxable. The government wanted to indict Capone for income tax evasion, Capone never filed an income tax return, owned nothing in his own name, and never made a declaration of assets or income.

so that is the key: become so rich that you own nothing and have no need for an income, but then again Mr Capone got caught.

Capone's mistake was 'Al Brown's Dry Cleaning', his legit business, where he claimed the income he reported came from. Charlie Lucky was smarter. He listed his occupation as 'gambler' on his tax returns [and arrest sheets]. Made proving the money was illegal [and the amount] much more difficult.

Ok, first go out and get a million dollars. Then when the taxman show up at your door and says, "You didn't pay your taxes." Two simple words in the English language. "I forgot."
