I realize your comment was not directed to me, but in its out-of-context state, I could not figure out if you were referring to Leo or the clerk in question.

In that your opinion is valued by many (including myself) I was hoping you would expand and clarify.

Yes, I was talking about Donofrio, not anyone here on FR. Having spent three decades working with the Clerks of Court, I surmise what is happening here. Donofrio has gone in like a bull in a china shop, concluding that anything the Clerk does which is not to his satisfaction, is due to bias. Now he has put that complaint in the Chief Justice's lap.

It will be denied. And that will be that for the Donofrio case.

Only twice in its modern history has the Court accepted a typewritten, not printed, brief. The second one was mine, and I got that right because I politely pointed out to the Clerk that in US v. Nixon his office had accepted such a brief with a promise to print it later.

You catch more flies with honey than with vinegar. This is a basic truth of human nature that Donofrio has ignored. He doesn't know what he is doing, and he is fouling the nest.
