Madoff and the Bail Issue

The ruling is in: Bail CONTINUED. This is the right decision, supporting both the Constitution and Salerno. He cannot intimidate financial records - the main witness against him. He isn't a flight risk - he's under 24-hour surveillance. Bail was only an issue because he is too comfortable in his penthouse. That just isn't the law.

The guy should be in jail. Period.

Gee, do you think that his attempt to send out checks and actually sending out jewelry is a problem?

not from a legal perspective under the law. not a bail issue. other means can be used to curtail that.

i am not defending the clown. if everything - or even a large part of what is alleged - is true, he should die in prison. but he hasn’t even been charged yet, let alone found guilty. this is turning into a feel-good prosecution.

just ain’t the constitution - which we hold up in other areas so prominently.

The issue was whether he violated the terms of his bail - apparently you and judge don’t think he did

Indeed. I would take the Wild West over this any day of the week. The West was dangerous, but at the end of the day, you knew the bad guys were going to get theirs.

If found guilty, he will go to jail. I know that he will throw all the resources and pull he has to get off this, but the police must protect him unless you’d like him lynched.

Lynching isn’t justice.

I would be in the county jail eating lumpy cream of wheat and rubber eggs....I think a little of that treatment would be appropriate.

Why would a criminal who has access to millions of dollars not be a significant flight risk? Due to his good character?

Stabbed, hung, shot, blown up, drowned, or just plain beaten to death....he doesn’t deserve preferential treatment just because he has only 1 Billion of the 50 billion he stole (3 million from his own sister), JUST BECAUSE the immedialte consequences may be a little gloomy....I say he needs a couple nights in the county!

Why? He is not a danger like a murderer or violent felon and it doesnt sound like he is a flight risk.

The right to bail has been firmly established in the Constitution and common law.

Follow the case more carefully. Madoff is busy scheming and dispersing all remaining assets. In Club Fed, he would have a much harder time communicating his criminal orders.
