To: Sorry screen name in use
In very simple terms.... Bush allowed Dr. Orly to get the documents... and she got some. I don’t know which ones she got.

Unfortunately, not accurate, in either respect.

Bush signed an executive order which allows the Executive Branch to get access to documents to vet its own employees. The Executive Order says that it is only for the internal use of the Executive Branch and cannot be enforced by any court or by anyone outside the Executive Branch. Specifically, section 7(d) of the Order says: "This order is intended only to improve the internal management of the executive branch and is not intended to, and does not, create any right or benefit, substantive or procedural, enforceable at law or in equity by any party against the United States, its agencies, instrumentalities, or entities, its officers, employees or agents, or any other person."

Orly, ignoring that paragraph of the Order, filed a lawsuit in California federal court trying to get access to Obama's birth certificate. She then sent a subpoena to Patrick Fitzgerald "demanding" that he give her all sorts of documents. She hasn't received anything yet, and I suspect that Fitzgerald will ignore her "order," since Orly has no power to subpoena him to do anything.

Just out of curiosity, why is this lawyer filing this suit in California?

Again, I haven’t a clue.

I didn’t take a third law course or something.

I understand Dr. Orly is seeking to compel or prod the Exeutive Branch and Attorney Generals to perform their jobs.

Step one of many to follow?
