You claimed that the border exception was the work of 'Bolsheviks' and the unqualified. I pointed out that Chief Justice Rehnquist, the author of the most recent affirmation of the border exception, was neither. That hardly amounts to endorsing rule by the smartest.

Open borders are primarily the result of policies set by Congress and the Executive, not the courts. Opposition to open borders and opposition to the border exception are hard to reconcile. Good border security requires the border exception.

Otherwise, unless one can stop and search the vehicles of travelers (and even pastors) in a routine manner in border areas, it becomes impossibly hard to detect vehicles loaded with illegals or drugs or anything else.

Simple. In order to protect the borders, it is necessary to routinely inspect vehicles crossing or near the borders.

One more time.

In a period of the largest possible army of Agents, with the widest possible, most generous legal "border exception" over the most extensive possible geographical territory the border is in more chaos than ever.

Illegal Immigrants cross at will to work, play, get drunk to kill people on US Highways and return home for the Holidays.

Whatever you want to call this, it sure is not "Conservative Governance".

It is not "Constitutional Governance".

And it sure as heck is not "Governs Best, Governs Least Governance"

If Rehnquist is proud of his role in this malignant evil cluster foxtrot it matters not what you call him-Conservative, Republican, Bolshevik, Oligarch, Bolshevik Oligarch, Kaskistocrat- he is part of the problem.

End result: the American Citizen Taxpayer is under assault from every conceivable direction, not just the "Border Exception".

There is also the "Game Warden Exception" (For The Animules),

The "Social Services Exception" (For the Chiiiiildren),

The "Health Inspector Exception" (For the Unwashed Dumb Masses),

The 'Agricultural Food Exception" (For The Rural Unwashed Dumb Masses),

"The "SWAT Team Break-Into-The-Wrong-Address Exception-At-Midnight"( For EVERYBODY),

"The Police (and SWAT Team) We-Will-Shoot-Your-Dog-By-Discharging-A-Firearm-Inches-From-Your-Loved-Ones Exception(Ditto),

The SWAT Team (and Police) "We-Did-Not-Mean-To-Shoot-Up-Your-House-And-Property-While-We-Were-Chasing-Bad-Guys Exception (Ditto Again),

AND do not forget and always remember "The Code Compliance Exception" (How tall does your grass grow, Citizen?)(Ditto,Once Again, For EVERYBODY)

Lest we forget, there is also the Japanese Internment Exception (National Security),

"The Original Aboriginal Immigrant Exception" (Herd All The Native Indians Onto Reservations And Do Not Let Them Leave) (Ditto, National Security),

And, of course, The "Take-Your-Shoes-Off-At-The-Airport-And-Acquire-And-Spread-Contagion-All-Over-The-Globe Exception"(Ditto,Once Again,National Security)

No doubt, better minds than mine could list many more, these are just the handful that occur to me off the top of my head.

So you want to defend the indefensible as a True Believer And Defender Of The Faith, feel free, but frankly, this begins to sound like a Robert Paulsen Thread (Ping To Robert Paulsen)

There are two distinct border exceptions-the limited border exception of your great-great-great-great Founding Father and the unlimited border exception of the Red Diaper Rooseveltian Era (Error).

To conflate the two as stare decisis is sheer lunacy.

I really have nothing more to add, though I am sure you do.

We are, far, far apart on this. Again, I suggest that you read the law review article I cited as. Even if it does not change your opinion, it may advance your side of the argument beyond tub thumping and fulmination.
