My Bad! I confused Atlanta Judge Land with Justice DAVID CARTER (who is the ex-marine I believe) in California who, the last I read, WILL hear the case in January, 2010.

Perhaps I confused Judge Land with Carter I thought Land was the ex-marine. Perhaps it was Carter that was the Marine like you said.

I knew that but had never heard of Land being in the military much less a marine.

That will depend upon his ruling regarding the motion to dismiss which he hasn’t ruled on yet. He held the hearing on Oct. 5 but has yet to rule on the motion.
