I have not been following the nomination process as closely as I should be... I am currently on Active Duty as an instructor and the U.S. Army Drill Sergeant School.. my days are a bit long.. in fact I gotta get off FR and get back to work... I hope my fellow FReepers can answer this question..

Here's a couple of things that should give anyone pause in her selection.

"In a 1996 paper, "Private Speech, Public Purpose: The Role of Governmental Motive in First Amendment Doctrine," Kagan argued it may be proper to suppress speech because it is offensive to society or to the government."

A couple of questions need to be asked of her. Who decides what is offensive? And what measures should be taken to "suppress" offensive speech? If she says something that society or the Government finds offensive, what measures will she agree with to "suppress" her comments?

"WND has reported that in her undergraduate thesis at Princeton, Kagan lamented the decline of socialism in the country as "sad" for those who still hope to "change America."

She should be grilled and drilled her and asked: If socialism has failed everywhere it has been tried, why should the United States implement it? And what other failures should the United States try?

Nominee argues giving president more power

She needs to be asked for examples situations that President Bush should have been given more powers to regulate. And, if in the future, an much much more conservative President should take office, and he takes it upon himself/herself to get involved in personally regulating matters, will she automatically agree that this is proper?

Basically what we have here, is a sophomoric, moronic sophomore. She is eminently unqualified to manage to roadside taco truck.

Oops - I forgot a really important one.

It's important to her that men who engage in filthy, disease spreading sexual practices be allowed to join the military. Then, when they are promoted they will prey on those of lower ranks.
