Granted McCain was a disaster. That didn't stop him from getting nominated and immigration wasn't a factor. He won both SC and FL. I get that you're upset. You have to get that you are, in that respect, part of a tiny, electorally insignificant minority.
As long as Perry's only competition is Romney there is no way he is hurt by any attack from the right on any subject. Attacks regarding immigration are particularly impotent. Face it, illegal immigration just isn't what people are focused on right now. Perry's foolish line on immigration is not a political loser. Quite the reverse. For every immigration die hard he alienates he'll attract several Hispanic voters, particularly in several key states.
There's a reason Tom Tancredo sank without a trace when he tried to run for President. The immigration issue just doesn't have the power that many people around here think it has.
Perry wasn’t a big supporter of the AZ law saying it wasn’t right for TX. Does the AG in Texas have a free hand in filing such briefs or must the Governor sign off on it? It works differently depending upon the state.
Of course they could and you can bet the farm that there will be a REAL effort to do exactly that in the next legislative secession!

Another way of reading the federal statute is that if a state provides in-state tuition to an alien not lawfully present, then it must provide in-state tuition to any US citizen or national without regard to in-state residence.
IOW, what is "the same benefit"?

I think that depends on the state. Some states have many people focused on illegal presence. And to the extent the public gets restive for work, and sees illegals getting work and benefits, the public will come to associate "bad economic times" with "presence of illegals."

No I am from Texas and would never have voted for him or Romney fron the start. He is no conservative. By the way it was 3 bad debates.

I did say that was for those who had entered the US legally and did not know what it would mean for an illegal. Note too that you have to have a moral character and be law abiding. So taking that in mind, wouldn’t there need to be special considerations for illegals?
What I am trying to square is: Congress mandated that the localities educate children of illegals K-12, yet it’s illegal to offer in-state college tuition to those same students.
The costs for the K-12 education would be considerably higher for a kid who went thru 13 years of TX public school (assuming s/he was admitted at K) than the ‘savings’ of in-state college tuition. That factors in the special ESL and other special ed features that a child from an illegal alien background would logically require.
So Congress is mandating the localities pay out @ $150-200K over 13 years, but also mandating that they stop there.
This really is a state issue IMO. VA not only doesn’t offer in-state, but IIRC, prohibits admission to our state schools to “undocumented” students. That’s our choice. If TX wants to offer in-state tuition it seems it’s their choice. Its state legislature voted overwhelmingly for it. TX/AZ/NM/CA have been dealing with this issue a whole lot longer than VA/MN/PA/MA, and undoubtedly see a benefit to that continued educational investment.
If Congress had not mandated the K-12 education (not to mention health care/food/shelter) to begin with, this would not be an issue, but again Congress stepped in with an unfunded mandate.

She talked to me about this program. I readily admitted we should have had an opt-in but I don’t know what part of opt out most parents don’t get and the fact is I erred on the side of life and I will always err on the side of life as a governor as a president of the United States.”
So does this all mean he’s going to race bait the Nation into accepting open borders and invasion? Does this mean that if we object to the expense, rape, robbery and murder of illegals, we are racists? Does this mean my money (taxpayers’ money) belongs to the illegals so we won’t be called racist or heartless?
It is heartless for the American elite to continue to ignore the unfair and deadly burden they place upon the people of America in imposing this unwanted invasion upon us. We are being made to suffer and die for an elitist cause that is basically treasonous and extremely thoughtless and cruel!

I am a member of a grassroots immigration group that lobbies on the Hill and in the statehouse. I also work with immigration groups around the country and with Tea Party groups. I traveled to SC and FL four days each following the McCain primary campaign in 2008.
SC has become one of the strongest states on the enforcement of our immigration laws. It is one of the states that has a law specifically prohibiting in-state tuition for illegal aliens along with GA, CO, and AZ. The issue of illegal immigration has become much bigger in the South. States like AL and NC are also getting tougher as is my state VA. We had over 40 bills get thru the House of Delegates only to be stopped by the Dem controlled Senate. We hope to flip the Senate this year.
FL has also become much more focussed on the immigration issue. The Tea Party and other immigration groups in FL are becoming more active and focussed. Perry will not help his standing within the GOP by his stance.
The GOP is deluded if they think they can pander to Hispanics and get their votes. The Dems got 65% of the Hispanic vote in 2008 despite having an amnesty supporter and La Raza award winner in McCain. Immigrants and minorities vote Dem.

In 1970, non-Hispanic whites comprised 89 percent of the population; today they are 66 percent; and by 2039, they will be 50 percent. The Democrats, under the banner of multiculturalism and diversity, have forged a political coalition that depends on individuals coalescing around racial and ethnic identities rather than the issues. The continuing and increasing flow of minority immigrants, mostly poor and uneducated, provide a natural constituency for the Democrats, which see them as their principal source of political power.
The U.S. adds one international migrant (net) every 36 seconds. Immigrants account for one in 8 U.S. residents, the highest level in more than 80 years. In 1970 it was one in 21; in 1980 it was one in 16; and in 1990 it was one in 13. In a decade, it will be one in 7, the highest it has been in our history. And by 2050, one in 5 residents of the U.S. will be foreign-born and one in three will be Hispanic.
