Obama Signs NDAA into Law. Last Pen Stroke of 2011.
Examiner ^ | December 31, 2011 | Jean Morrill

According to the ACLU, President Barack Obama just signed one of the most controversial bills into law since the Patriot Act. The sad part is that neither the House nor the Senate nor Obama seemed to think it was all that controversial, as it passed overwhelmingly in both the House and the Senate, and the president just signed it (even though he had at one time threatened to veto).

Thanks Sunk. Several pages above the detainee section caught my eye. Something to do with the internet - called the “Ozone Widget Framework”. All the jargon they use - who knows WTH it means or refers to.

Sounds like a “spooky” name though.

The Posse Comitatus Act is the United States federal law (18 U.S.C. § 1385) that was passed on June 18, 1878, after the end of Reconstruction. Its intent (in concert with the Insurrection Act of 1807) was to limit the powers of local governments and law enforcement agencies from using federal military personnel to enforce the laws of the land. Contrary to popular belief, the Act does not prohibit members of the Army from exercising state law enforcement, police, or peace officer powers that maintain "law and order";

it simply requires that any orders to do so must originate with the United States Constitution or Act of Congress.

The statute only addresses the US Army and the US Air Force. It does not refer to, and thus does not implicitly apply to nor restrict units of the National Guard under federal authority from acting in a law enforcement capacity within the United States. The Navy and Marine Corps are prohibited by a Department of Defense directive, (self-regulation,) not by the Act itself.[1][2] Although it is a military force,[3] the U.S. Coast Guard, which now operates under the Department of Homeland Security, is also not covered by the Posse Comitatus Act

Posse Comitatus

Well, I guess they now have their authorization...

Beginning on page 411 of the 35th Anniversary Edition of Atlas Shrugged:

"Did you really think that we want those laws to be observed?" said Dr. Ferris. "We want them broken. You'd better get it straight that it's not a bunch of boy scouts you're up against - then you'll know that this is not the age for beautiful gestures. We're after power and we mean it. You fellows were pikers, but we know the real trick, and you'd better get wise to it. There's no way to rule innocent men. The only power any government has is the power to crack down on criminals. Well, when there aren't enough criminals, one makes them. One declares so many things to be a crime that it becomes impossible for men to live without breaking laws. Who wants a nation of law-abiding citizens? What's there in that for anyone? But just pass the kind of laws that can neither be observed nor enforced nor objectively interpreted - and you create a nation of law-breakers - and then you cash in on guilt. Now, that's the system, Mr. Rearden, that's the game, and once you understand it, you'll be much easier to deal with."

Whatever 'rules' they have in place will be easily ignored.

This needs to be struck down by the SC.

Let us see...

A foreign terrorist captured on a foreign soil waging war on US troops should get a trial in a NYC civil court.

A US citizen who says something the president doesn’t like can be sent to Gitmo indefinilty.

This has got to be some sort of mental disorder.

“For the upcoming election propaganda to work, the opposition must be painted as racist or dangerous, with the outspoken to be detained ad infinitum. And, the internet communications of same must be suppressed.”

Exactly

“the Act legislatively codifies[6] the President’s authority to indefinitely detain terrorism suspects, including American **citizens**, without trial as defined in Title X, Subtitle D, SEC 1021(a-e) of the law.”

Guess this means he [Obama] will never have this act used against himself.

Article One, Section 9, clause 2 United States Constitution "The privilege of the writ of habeas corpus shall not be suspended, unless when in cases of rebellion or invasion the public safety may require it."

Title X, Subtitle D, SEC 1021(a-e) states:SEC. 1021. AFFIRMATION OF AUTHORITY OF THE ARMED FORCES OF THE UNITED STATES TO DETAIN COVERED PERSONS PURSUANT TO THE AUTHORIZATION FOR USE OF MILITARY FORCE.

(a) In General- Congress affirms that the authority of the President to use all necessary and appropriate force pursuant to the Authorization for Use of Military Force (Public Law 107-40; 50 U.S.C. 1541 note) includes the authority for the Armed Forces of the United States to detain covered persons (as defined in subsection (b)) pending disposition under the law of war.

(b) Covered Persons- A covered person under this section is any person as follows:

(1) A person who planned, authorized, committed, or aided the terrorist attacks that occurred on September 11, 2001, or harbored those responsible for those attacks.

(2) A person who was a part of or substantially supported al-Qaeda, the Taliban, or associated forces that are engaged in hostilities against the United States or its coalition partners, including any person who has committed a belligerent act or has directly supported such hostilities in aid of such enemy forces.

(c) Disposition Under Law of War- The disposition of a person under the law of war as described in subsection (a) may include the following:

(1) Detention under the law of war without trial until the end of the hostilities authorized by the Authorization for Use of Military Force.

(2) Trial under chapter 47A of title 10, United States Code (as amended by the Military Commissions Act of 2009 (title XVIII of Public Law 111-84)).

(3) Transfer for trial by an alternative court or competent tribunal having lawful jurisdiction.

(4) Transfer to the custody or control of the person's country of origin, any other foreign country, or any other foreign entity.

Has Congress just declared that the "War on Terror" constitutes a rebellion or invasion under the Constitution, or have they merely declared that, as usual, they have no respect for the rule of law? Personally, I have no trouble with killing US citizens on the battlefield, nor do I have trouble with lawful trials if they are captured rather than killed. I have a huge problem with subverting the Constitution. Obama disgusts me, as do the vast majority of Congresscritters who failed to read and understand this offensive and unconstitutional bill, or who no longer care if their actions are compatible with the Supreme Law of the Land.

God's prophetic plan continues to unfold.

This nation was formed by God. The founding fathers realized a divine vision.

Jude 1:4- ...For certain men have crept in unnoticed, who long ago were marked out for condemnation, ungodly men, who turn the grace of our God in to lewdness and deny the only Lord God and our Lord Jesus Christ.

Because of this nations turn toward all kinds of deviant behavior, turning our backs on Israel and protecting Islam, God's not too happy with America. We are in decline.

Perhaps God is lifting His hand of providence from the nation he blessed.

Just sayin.

For drafting this bill McCain deserves to be put into a jail cell with a few sexual predators, and little supervision from a guard that couldn’t care less.
