A link to the transcript of Nadia Naffe’s Testimony Against James O’Keefe as well as some interesting commentary can be found here (I know nothing about this website, but it had some interesting commentary). It sounds to me like the court was having trouble even figuring out if there even was a real allegation of any misconduct against James O'Keefe. Keith Olbermann's characterization of the incident appears to be a hyperbolic fabrication.

Except that the opposing council will argue that since no one watches Al Gore's TV channel, there was no damage done to James. :)
