The Supreme Court decision on obama care, no matter which way it goes, will be the ‘new’ shot heard ‘round the world for this country.
I don’t know if this would fly, but it appears to me that Arizona has a case against Homeland Security based on a violation of the Administrative Procedures Act.
My thinking is that the withdrawal of the 287.5(e)(3) certification is arbitrary and capricious and is not based on any allegations of the LEO’s in Arizona failing to comply with the law, rules and regulations under 287, and, thus the rescinding of the authority to perform the functions authorized under 287 is an act of retaliation not an act based on objective fact finding.
Once the authorization to act under 287 is given, rescinding that authority , I believe, needs to be based on the individual LEO’s performing functions outside of the law. Since the Court has stated that the “your papers please” is constitutional, using the fact that the state now has the Court’s permission to ask for papers is not a reason for rescinding the 287.

I would love to see Jan Brewer mobilize the Arizona National Guard on the border,and for Sheriff Joe to deputize
a few thousand volunteers to help turn back the hordes coming through the border.
Money to pay for equipment, gas, salaries, would come off the gasoline tax collected by the State and forwarded to the Federal government.
A seven month showdown has now commenced, whether anyone wants to believe it or not. This is 1860 all over again, and I do not say that lightly.
Rick Perry of TX and Susan Hernandez of NM need to join Arizona in such a move.
The Federal government is now deliberately endangering the lives of al residents in the Southwest, and by extension the rest of Aericans also.
Congress has to see a shi!tstorm of protests by their constituents.
Obama, Holder, Napolitano and Clinton are enemies of the state now. Not only of Arizona, but of all the states now, and the state of the Union.
Pretty soon the joint Chiefs are going to have make a very serious decision soon if this lawlessness continues.
So the SCOTUS upholds he AZ law that allows officers to check IDs, but once the person is found to be an illegal, the officer can do nothing, ie. if the person is arrested no federal court in AZ will prosecute.
Whoa... these are scary times are they not? Who’s decision was this and why? Don’t we have a right to know? Let’s ask Obama.
This is wrong, and I say if Romney can’t speak up when asked a simple question then to heck with him too.
