I recall Alito, not Roberts, was the Miers replacement. Alito is fine. I believe Roberts signed on to keep Kennedy from writing the decision. That kind of reasoning never works out. I would have rather it be 5-4 if need be.

There's no reason to believe Myers would've been any better.Not suggesting she would have been. But there was great glee with her stepping aside and Roberts being the nominee. He was to be indicative of a further shift to the right of the court since initially he was to replace Sandra Day O'Conner. He was seen as a seismic right shift.
