Then why do they think the law “will have little effect on the 2012 election”?

I believe it IS in effect and should Romney win the pop and zero the ec and CA flips to Romney because of it Zero will be the first to run screaming to the courts.

(it should be said that as much as I hate zero, I do think this law needs to be challenged as it was not the framers intent for the EC to work this way)

The law is in effect in California, but the compact is not in effect because not enough States have passed a similar law. California is not bound by it yet.
