Yet states that have set up a health care exchange are already predicting huge increases in the estimated costs within the first couple of years.

The heck with exchanges, states should start forming and training their own infantry regiments. A better return on investment.

All well and good, but a few little PROBLEMS remain for Big Brother: HHS has been given NO MONEY by congress to set up an exchange in any state which has refused to set up its own. So charging a fee is dandy, but where will the money LEGALLY come from to set up the fee charging exchange in the first place?
Secondly, states may sue the feds for trying to set up exchanges at all! The issue of the legality of running an ObamaCare exchange in an unwilling state is far from settled.

Did he even try to claim a legal justification for the fee, or he just pissed off about states passing this back to the federales so he can impose any fee he feels like?
