He doesn’t have the authority to circumvent the constitution with an EO. I wouldn’t be surprised if he tries and I wouldn’t be surprised if Boehner lets it slide.

Last count I saw, he has signed more than 350 executive orders. Many circumvent the law. No one has stopped him or even raised their voice.
He doesn't care about the law. At all. And no one is stopping him.

Insofar as SBRs are regulated as they are, and those regulations are longstanding (since 1934), and the only thing separating AWs from SBRs is the number 16”, one EO is very viable.
