Until SCOTUS has clarified an issue it’s up for grabs. The Constitutionality of Obamacare is a prime example of this. All the “birthers” have ever asked is that the issue be weighed according to the rules of evidence, with all the evidence on the table, and a determination made by the proper authorities.
