O.C. Deputy Charged with Pepper Spraying Teen's Pizza

A sheriff's deputy in Orange County will be arraigned Monday for allegedly pepper-spraying a teenager's pizza during a traffic stop.
The teen, authorities said, and a group of friends later became sick after eating the pepper-spray tainted pizza.
Authorities charged Juan Tavera, 30, with one misdemeanor count of assault or battery by a public officer. If convicted, he faces a maximum sentence of one year in jail, according to the Orange County district attorney's office.

I saw a prison guard spray his sandwich once. (I was doing a service call on a computer there.) I don’t get it. If it was so hot as to make them sick, how/why did they eat it?

Tavera is accused of spotting a pizza on the back seat of the victim's car and then pepper spraying it without the teen noticing. Any non-cop who put a toxic substance on a cop's food would go to prison for a long time. If true, this cop needs to be fired and arrested.
Then again, it's not impossible that the teen had a bad experience with the cop, pepper sprayed his own pizza, and then reported it. Chemical analysis should determine if the pepper spray was the kind cops use.

The incident occurred 11 months ago and turned over to the OCDA’s office. So it is very likely the evidence was tested and the cop arrested.

Felony poisoning.

Product tapering, assault, mayhem, attempted murder, civil rights violations (thought crime depending on ethnicities of all involved of course!), improper disposal of chemical agents, and probably a dozen or so other offenses.
It certainly wouldn't be a single misdemeanor charge, would it?
And we certainly wouldn't be on paid vacation leave for the duration either.
