He got away with his other exercises of "prosecutorial discretion" (dream act amnesty, drug laws) because it involved federal enforcement, and nobody else had standing. E.g., when states tried to enforce immigration law, the courts stopped them.

But this extension of old ins. policies in violation of Obamacare is different. These insurance contracts can be challenged by individuals in court, where the written law applies, and Obama's prosecutorial discretion is irrelevant.
