I think they’ve differentiated between an actual flyable flag and what is considered a “picture” of a flag.

I also have problems with U.S. Flag Code 8(i): “The flag should never be used for advertising purposes in any manner whatsoever.” Given the prominent display of ‘Polo’ and ‘RL”, I’d certain consider these flags as being used for advertising purposes.
