LaVoy went to the Taser prongs sticking out of his left back - not his shoulder holster.
From what I've seen on the video though, they wouldn't want me on the jury. I'd have a hard time clearing anyone (law enforcement or civilian) for having shot and killed him. From what I've seen, not justifiable at all IMHO.
The officers appeared to be way too far away to hit him with a taser. The maximum effective range for a taser is 35 feet. I didn't see anyone closer than 50 feet. (except maybe the guy he almost ran over). Plus with the winter coat on, the effective range would probably be about 20 feet. The officer would literally have had to stand next to him to fire a taser.
It looked to me that he was in the act of disarming himself under the direction of law enforcement. e.g. Throw your weapon on the ground.
I think they planned to shoot in while he was in the act of disarming himself. That makes it premeditated murder.
He was not a stupid man. He would have not tried to have a shoot out with guns all around him. He would have figured that he could cop a plea to trespassing.
Must have been one hell of a taser. I didn't see anyone near enough to him to use a taser. Is there a piece of video I missed?
I mean this fella was outta the vehicle seconds after it was lodged into the snow bank.
