"Clearance" is NOT "need to know". If you are provided or seek out material that is appropriate for your classification level but for which you have no need, you are in violation of the clearance. This justifies prosecution for espionage.

I never said he could not, nor should not have been prosecuting.

I was merely explaining what he was charged with. Personally, I don’t care. Evidently handling classified material in a hap hazard way is not a big deal anymore. (Sarc.)
