I read a FR post earlier regarding Director Comey. The theory is - HRC gets a pass b/c he knows Trump will win, and after the inauguration the FBI will be able to convene a grand jury and get an indictment

If the FBI dropped the hammer now, the preezy will issue a pardon. With no indictment, no pardon will be issued.

I want to believe that Trump/Comey have outsmarted HRC! This is going to be great fun.

I tend to agree with this. Otherwise, why say again you don’t have intent, when intent may well be found in the texts of an aged in email

I believe that win or lose, Obama will issue a blanket pardon of Hillary (a la Ford's pardon of Nixon). In Nixon's case, there had been no convictions or indictments. It covered any crimes that he might have committed during his presidency. With that precedent, Obama can virtually wave a magic wand. Furthermore, he will pardon Cheryl Mills, Huma Abedin, Loretta Lynch, the Bleachbit guys, the IT guys, well, everyone. What can anyone do about it? I still say that there should be an amendment to the Constitution which provides for a review of presidential pardons. I don't know what the format should be, but, let us say, a pardon can be nullified if say one-third of Congress votes that the pardon was not an 'arms length transaction'. In other words, a president who pardons individuals who could potentially testify against him could have the pardon nullified if a large enough minority (I don't think that this should require a majority) of Congress had reservations about it.

Of course there is another school of thought that if Hillary loses, she can do nothing more for him, and he will let her twist in the wind. I doubt this, because, being a Clinton, she no doubt has the goods on him.

If that theory is true, why the need for the announcement? It would have been smarter to just let things play out if that theory held any water.
