She died on the eve of Rosh Hashanah. Sounds like a good way to start a new year.

I did not agree with her judicial philosophy and felt like she was very political. Some of that was of her own doing and much of it is simply a reflection of the political divide in our nation today and the fact that the court has in many ways become a defacto unelected legislative body.

We all have our own opinions, but she did achieve much at a time where other women did not. She has faced her own judgment and that is between her and God.

It is fair to point out that of all the liberal justices, she was the one who most confused me. For a person who allegedly cared enough about the “politics” of her position she should have retired and allowed Obama to appoint another judge in her place, but she did not. On the other hand, she wrote some interesting opinions that exhibited a keen mind.

We all knew there was a high probability that she might pass on during the Trump administration given her lengthy battle with cancer. Like most on the political left she expected Clinton to win so I don’t think she gave retirement much consideration. Her health has been a cloud over the left from the day Clinton conceded.

Trump is now on the precipice of dominating the court for decades via his appointments. Obama picked older nominees with a history of health problems because they believed they had secured power - they did not.

It is quite possible that one of the left wing judges and two of the conservative judges now on the court will be replaced in a second term of Trump. Trump picked younger and more vigorous jurists so consider the possibility if the stars align that Trump will have nominated and confirmed 6 of the 9 justices by 2024.

If this occurs, SCOTUS will be the “Trump court” for two or more decades as SCOTUS is unlikely to approve of stacking the court despite what they say on MSDNC or CNN.

In an ideal world, SCOTUS will rein in the district courts that have acted as single person legislatures. We can all talk about how “huge” this would be and it would not be an exaggeration or even begin to approach how influential this would be on the nation for the next twenty years or longer.
