When I was teaching and we confiscated a kid’s phone (parents had to come and pick it up), we were told to have him or her turn it off before giving it to us. The thinking was that if the kid’s 15-year-old girlfriend sexted him a naked picture of herself, it could be claimed we were an adult in possession of child pornography. Now, I never heard of any teacher being prosecuted under these circumstances, but that’s how we had to deal with it. No school adult would turn on that phone. Also, to be fair, what was on the phone was none of our business.
