Killing guerrillas is not a crime, although historically the Germans were prone to extend the title to anyone who appeared to give aid to those who opposed them. Randomly rounding up male citizens from a town where guerrilla activity occurred and hanging them with no trial, no defense and no proof of guerrilla activity, then yes, that is a war crime.

The Nazis did quite a lot of that sort of thing during the war, much more in Eastern and Central Europe than in France.

When you invade their country, yes it’s a crime to simply murder them. The invader loses all kinds of rights.
