Is that even legal? The jury returned a verdict.

Wouldn't the motion for a new trial be an appellate decision?

No. You have to move the trial court for a Motion for new trial. Then, when and if that Motion gets denied, you file your appeal of the denial of that Motion with the Court of Appeals.

Then that's what you argue on appeal -- that the trial court should have granted your motion for a new trial.
