The next step,I need FReeper input

I am so mad my blood is boiling. I still cannot get over, nor want to get over the outrage I feel for a little 10 year old girl in Mundelien Illinois. She was repeatedly raped by some illegal aliens, and instead of prison, they were just sent home!! We all know they will be back in the states next week, molesting other children NEXT WEEK!

Here is where I need help and advice. The Judge.. Victoria Rosetti has done this before! She uses deportation as a punishment. Is she that stupid that she will not admit the crimminals (sexual Predators) will be back in a week?

Is she re-writing the law? What steps can be taken to stop her? She is a Republican Judge, up for election with no one running against her.

I am part of a radio show "Perspectices on our Heritage" and we want to stir up publicity around it. Mundeline is just north of Chicago. What can be done to question her Judge worthiness? Has she herself broken any laws by giving a deportation sentence?

I am gonna post some articles, 3 to be exact, and you can see her rulings in these cases.

Check out the one about the American flag. I want to put a lot of effort into exposing this Blank-blank-blank Judge!! Help me out Freepers! Any FReeper Lawyers out there?

You saw this.......................... Guilty plea results in deportation By Tony Gordon Daily Herald Legal Affairs Writer

A pair of illegal immigrants agreed not to contest their deportation, and by doing so avoided five-year prison sentences for molesting a Mundelein girl.

Cousins Antonio Reyes-Angeles, 25, and Isidro Reyes-Lorenzo, 20, pleaded guilty to aggravated criminal sexual abuse during a Monday hearing before Circuit Judge Victoria Rossetti.

The two were sentenced to five years in prison, but Rossetti agreed to put the prison time on hold in exchange for their agreement to cooperate with the Department of Immigration and Customs Enforcement's efforts to deport them.

"They cannot assert their right to remain in the United States in any way," Assistant State's Attorney Marykay Foy said. "They either voluntarily return to Mexico, or are taken to prison."

The two admitted molesting a 10-year-old girl several times between January and April of this year in Mundelein.

Mundelein police arrested the men after the girl reported the attacks to a Hawthorn Middle School counselor who called police.

Sex predator to go free in Mexico, judge says Waukegan -- A Waukegan man will be deported and be a free man in Mexico despite pleading guilty Monday to predatory criminal sexual assault of a child, authorities said. -- Mateo Briseno was charged with sexually assaulting a girl, 12, between Dec. 1 and Jan. 21 in a Waukegan residence, authorities said. -- Lake County Circuit Judge Victoria Rossetti sentenced Briseno to 8 years in prison but stayed his sentence on the condition that the U.S. attorney general's office return him to Mexico.

The American Flag story

Too-loud flapping flag earns $100 fine

June 22, 2000

BY DAVE NEWBART SUBURBAN REPORTER

Considering Thomas LaBarbera's recent legal troubles, maybe the American flag outside his Grayslake home should have been at half-staff Wednesday. But it wasn't flying at all.

LaBarbera, 40, was found guilty this week of disturbing the peace after neighbors complained that his flag was too noisy.

After the ruling Tuesday, LaBarbera removed the Stars and Stripes from the pole it had flown from, on and off, for the past seven years.

"Can you believe it?" LaBarbera, an engineer, said of Lake County Judge Victoria Rosetti's finding him guilty and fining him $100. "Our flag should stand no matter what."

Not when it's noisy, some of LaBarbera's neighbors said.

Terrance Horan, whose bedroom window is 14 feet from the flagpole, testified he couldn't sleep because of the racket when the clips securing the flag banged against the aluminum pole.

Grayslake police Cmdr. Matt McCutcheon said police responded to several complaints the past few years about the noisy flag.

They tried to work out a compromise, getting LaBarbera to attach padding to the pole.

Apparently that wasn't enough. On May 31, neighbors complained again, and police ticketed LaBarbera for disturbing the peace.

The judge agreed. Besides fining LaBarbera, she also placed him under court supervision for 90 days.

So LaBarbera took down his flag.

"I don't know what else I should do," said LaBarbera, whose three brothers served in the military. "I'm shocked. This is the American flag."

Same thing happened about ten years ago to a guy I was working for at the time.

An illegal alien with no insurance or license and slam drunk ran a red light at the end of an interstate exit ramp and hit the guy's wife's car broadside in the passenger door, killing the wife instantly.

The illegal alien served about 45 days until his court date, he was found guilty, and the judge deported him.

Most of the time in this state, vehicular homicide aggravated by DUI carries double digit sentences.

FWIW...If anything like this happens to any female in my family, I will be forced to assume there will be no justice through the law.

That's not racism or hatred on my part, it's the fault of the criminal justice sytem.

The honorable Judge Rossetti.

What she did was get them out before they were convicted for JUST the rape.   See last paragraph.

TITLE 8 > CHAPTER 12 > SUBCHAPTER II > Part IV > Sec. 1228. Prev | Next

Sec. 1228. - Expedited removal of aliens convicted of committing aggravated felonies

(a) Removal of criminal aliens

(1) in general

The Attorney General shall provide for the availability of special removal proceedings at certain Federal, State, and local correctional facilities for aliens convicted of any criminal offense covered in section 1227(a)(2)(A)(iii), (B), (C), or (D) of this title, or any offense covered by section 1227(a)(2)(A)(ii) of this title for which both predicate offenses are, without regard to the date of their commission, otherwise covered by section 1227(a)(2)(A)(i) of this title. Such proceedings shall be conducted in conformity with section 1229a of this title (except as otherwise provided in this section), and in a manner which eliminates the need for additional detention at any processing center of the Service and in a manner which assures expeditious removal following the end of the alien's incarceration for the underlying sentence. Nothing in this section shall be construed to create any substantive or procedural right or benefit that is legally enforceable by any party against the United States or its agencies or officers or any other person.

(2) Implementation

With respect to an alien convicted of an aggravated felony who is taken into custody by the Attorney General pursuant to section 1226(c) of this title, the Attorney General shall, to the maximum extent practicable, detain any such felon at a facility at which other such aliens are detained. In the selection of such facility, the Attorney General shall make reasonable efforts to ensure that the alien's access to counsel and right to counsel under section 1362 of this title are not impaired.

(3) Expedited proceedings

(A)

Notwithstanding any other provision of law, the Attorney General shall provide for the initiation and, to the extent possible, the completion of removal proceedings, and any administrative appeals thereof, in the case of any alien convicted of an aggravated felony before the alien's release from incarceration for the underlying aggravated felony.

(B)

Nothing in this section shall be construed as requiring the Attorney General to effect the removal of any alien sentenced to actual incarceration, before release from the penitentiary or correctional institution where such alien is confined.

a bit more explicit . . .

Nothing in this section shall be construed as requiring the Attorney General to effect the removal of any alien sentenced to actual incarceration, before release from the penitentiary or correctional institution where such alien is confined.

Since the good judge was responsible for the sentencing of the illegal aliens, she would be the only one responsible for ANY FUTURE EVENTS. She had the power to sent them to jail for as long as she wanted to. Evidently she did not want to.

Well, you already know I'm outraged @ this judge's decision.

I hope someone can tell us if these rulings are setting case 'precedent' for future illegal criminals.

Don't bet on it, since thousands cross our borders, everyday, undetected.

Good.......the next time these scumbags molest a kid, I hope the parents sue this *honorable* judge for all she's got (including the bench she's sitting on).

I'll back the parents/kids, no matter which country they live in.

Reader's Digest runs a monthly segment called 'That's Outrageous' in which they out bad judges.

I subscribe to their web site, I'll submit this to them as a way to give Victoria a little more exposure.

Here's an interesting thread we both missed.....

http://www.freerepublic.com/focus/f-news/1179876/posts

(snip)
"It was around 6:40 a.m. Friday when Jorge Gonzalez-Lopez was taken into custody about six miles east of Douglas, Andrea Zortman said."
"During normal processing, his fingerprints came back as a person who was convicted of child molestation in 2003 in Washington state, she added."

(convicted of child molestation in WA state in 2003 ??? either his sentence was very short, or WA state has a "deport for punishment" judge also).

(also)
"Since Oct. 1, 2003, through Sunday, 9,051 illegal immigrants with criminal records have been apprehended in the Tucson Sector."

(that's about 1000 convicted criminals a month coming thru ONE section of our southern border......& that's ONLY the one's we caught)

(let me guess....I'm sure they all *promised* they wouldn't re-enter the USA)

If I am lucky enough I got to talk to a big name at out Channel 7 news.
I told him the story about the judge and her "Punishments"
she hands down. He gave me his card, took my phone number and jotted down the information. Might be in luck, maybe the story will get some big coverage.
