I had the same reaction too. This was an attempt to set up a mood of the voters to favor the filibuster of Bush's judges.

It's a set up to gain democrat support for denying Bush his judicial appointments.
Good gamble on the part of democrats.
According to polls, the Shiavo case is vastly
