Judge seeks vets’ names in horse cruelty case

HERALD-LEADER STAFF REPORT

Fayette District Judge Joseph T. Bouvier overruled a defense motion today to dismiss misdemeanor animal-cruelty charges against Nancy and Kathleen Nygaard. But the judge directed the county attorney’s office to identify the veterinarians who treated and assessed the malnourished and dehydrated horses taken from the Nygaards’ rented Yarnallton Pike property and to disclose those vets’ assessments.

Defense attorney Jerome Baker Jr. contended the charges should be dismissed because the arrest warrants were issued on "legally insufficient" criminal complaints that didn’t name the vets, what they observed or how and where their observations were made.

Nancy Nygaard, 64, and her daughter, Kathleen, 30, are each charged with nine counts of second-degree animal cruelty; each count carries penalties of up to a $500 fine, 12 months in jail or both. The Nygaards maintain they did everything they knew to do to take proper care of the animals, including veterinary care, while the animals were in their custody.

The Nygaards are scheduled to go on trial May 3 and 4, but Bouvier indicated he is open to a defense request to move the trial to June 7 and 8.
