Cutting Neighbor's trees

I hope some of the Freepers can help me out with a problem that has risen in our Family. My Son and Daughter in Law live in a small town in Western Montana. They recently bought a six acre + or - piece of property on a lake. They plan to build a home on the property, the problem they have is that the neighbors who live across the road and above the kids property has been coming over when no one is around, and cutting down trees that obstruct their view.

The neighbor on the other side of the kids has seen this person cut down the trees, and has reported it to my Son and Daughter in Law.

I wonder if any of the Freepers have a suggestion as to how to handle this .?? Thanks in advance. BooBoo

I don't know how they do things in Montana, but there was a sitting judge in Seattle that was fined, criminally I believe, for doing the exact same thing. I know of another instance south of Seattle where someone was arrested for destruction of property when they did that. Run it by the local police of sheriff

Depending on how far they want to go, you can install a motion sensor activated camera, the kind that hunters use to check game trails, and get photographic evidence of the trespass.

Or just have a lawyer draft a "cease and desist" letter addressed to the offending party.

Have the neighbor call the cops when this happens.

Have the neighbor video tape/photograph the tree-choppers and then sue them.

Have your son contact local law enforcement in the area and ask for their advice.

Repeated shotgun blasts. Confront the people doing it and tell them they'll be shot for trespassing. One doesn't have to do it but an a*sful of rock salt might do the trick.

When I moved into my place I knew that my neighbor wanted to have a better view of the lake so I worked with him and showed him what trees I wouldn't mind getting rid of. I can't get out and cut trees anymore so it works out great for us.

Other than trying to work with your neighbor all you can really do is file a police report. For that matter the treehuggers might have a few solutions but be carefull of liabilities.

If the neighbors didn't tell them, would they even know the trees were trimmed? If not, who cares?

If it looks bad, and if you are worried about them hurting themselves on your land and suing you, then report it to the police.

The other thing you could do is to figure what view they are looking at and to then run a sign below blocking that view advocating the natural growth of trees without being subject to being cut by non-owners.

Hmmm, dig deep pits and carefully camoflauge them with leaves and debris. Pongee sticks would be a creative touch. If that is too much work, lay a trapline. Hey, they're trespassing, right?

I'm joking :-) Over the years, I've run into some truly horrible neighbors. Good luck to your kids.

Our neighbor had that happen, and the offender paid a lot of money for loss of lumber and view. Have them call a lawyer.

Post no trespassings signs and send him an invoice for $5,000 for each unauthorized tree cut and other damage to your property. Then be prepared to take him to court to sue his butt for the cash.

Have them wait until the neighbor is out of town and then burn their house down.

Kidnap their kid and take a finger for each tree that goes missing.

Actually I would call the local sheriff, being from Montana I know property rights are VERY important to the natives and the police may be able to help with surveilannce equipment. Either that or cut the brake lines on their car

Google Neighbor Law. It's a good book on fences, trees, boundaries and sound. It has helped me several times as a property owner.

Get pictures.

Have a lawyer draw up a bill, and send it with a copy of the pictures.

The bill should include pain and suffering. If they want to fight the bill, they'll have to get a lawyer...I think.

If the neighbors have already cut the trees it's a little late for talking to them. Now is the time for RETRIBUTION!!

Actually if they have no proof of them doing this it may be best to go up to them and say "Hi I'm your new neigbor and were wondering if anyone's been illegally cutting trees on you land because they been on ours and we're getting a motion censor activated cameras to catch them if you want to chip in on the cost" That way they don't get into family fued right off the bat and they get to keep the remaining trees. Either that or they could put aluminum shavings in their gas tank or poison their well with arsenic.
