Do not let the victims of the attacks on New York and Washington, nor the brave members of our Nation's military who have given their lives to protect our freedom, die in vain!!

Senate Minority Leader Harry Reid has called upon Karl Rove to resign, and upon the President to pressure him to do so.

In response, it appears likely the President will throw Senator Reid the Senatorial bird (as opposed to Senator Byrd, but that's another rant...) by nominating Circuit Court Judge Samuel Alito (another nominee that's going to take some typing practice to spell correctly, oh well).

A synopsis of the Judge's actual judicial opinions [Courtesy: FR's YaYa123]:

A majority opinion in ACLU v. Schundler, 168 F.3d 92 (3d Cir. 1999), holding that the Establishment Clause was not violated by a city hall holiday display that contained a creche, a menorah, secular symbols of the season, and a banner proclaiming the city's dedication to diversity.

A majority opinion in Fatin v. INS, 12 F.3d 1233 (3d Cir. 1993), holding that an Iranian woman seeking asylum could establish that she had a well founded fear of persecution in Iran if she could show that compliance with that country's "gender specific laws and repressive social norms," such as the requirement that women wear a veil in public, would be deeply abhorrent to her. Judge Alito also held that she could establish eligibility for asylum by showing that she would be persecuted because of gender, belief in feminism, or membership in a feminist group.

A majority opinion in Saxe v. State College Area School District, 240 F.3d 200 (3d Cir. 2001), striking down as contrary to the First Amendment a public school district anti-harassment policy that extended to nonvulgar, non-school-sponsored speech that posed no realistic threat of substantial disruption of school work.

A majority opinion in Shore Regional High School Board of Education v. P.S., 381 F.3d 194 (3d Cir. 2004), holding that a school district did not provide a high school student with a free and appropriate public education, as required by the Individuals with Disabilities Education Act, when it failed to protect the student from bullying by fellow students who taunted the student based on his lack of athleticism and his perceived sexual orientation.

A majority opinion in Williams v. Price, 343 F.3d 223 (3d Cir. 2003), granting a writ of habeas corpus to an African-American state prisoner after state courts had refused to consider the testimony of a witness who stated that a juror had uttered derogatory remarks about African Americans during an encounter in the courthouse after the conclusion of the trial.

A dissenting opinion in Planned Parenthood v. Casey, 947 F.2d 682 (3d Cir. 1991), arguing that a Pennsylvania that required women seeking abortions to inform their husbands should have been upheld. As Judge Alito reasoned, "[t]he Pennsylvania legislature could have rationally believed that some married women are initially inclined to obtain an abortion without their husbands' knowledge because of perceived problems--such as economic constraints, future plans, or the husbands' previously expressed opposition--that may be obviated by discussion prior to the abortion." Chief Justice Rehnquist's dissent from the Supreme Court's 5-4 [corrected] decision striking down the spousal notification provision of the law quoted Judge Alito's dissent and expressed support for Judge Alito's reasoning.

A dissenting opinion in Homar v. Gilbert, 89 F.3d 1009 (3d Cir. 1996) arguing that that a state university did not violate the procedural due process rights of a campus policeman when it suspended him without pay and without a prior hearing upon learning that he had been arrested and charged with drug offenses. The Supreme Court, which reversed and remanded the case on other grounds, agreed with Judge Alito's reasoning that no hearing was required prior to the suspension because the drug charges showed that the suspension was not baseless.

A dissenting opinion in Sheridan v. Dupont, 74 F.3d 1439 (3d Cir. 1996) (en banc) arguing that a plaintiff in a sex discrimination case should not inevitably be able to survive summary judgment simply by casting doubt on the employer's proffer of legitimate, nondiscriminatory reasons for the adverse employment decision.

Folks--I think we have a real conservative here.

As I said on Friday, the President plays chess, and we need to stick with him.

Now, for the Gang of Seven in the Senate--we're watching. Harry Reid hates this guy. This is well worth the Nuclear Option.

In other news...

The Plamegate special prosecutor is demanding that VP Cheney testify in open court. The Administration will likely invoke Executive Priviledge--sparking a court fight on that issue.

And Prince Charles says he finds the pace of climate change is terrifying and people are becoming too dependent on technology.

Carolinamom - My bet is the better part of your self will win any battle that needs to be won.

Bevlar - thinking of you on this two year anniversary.

My brother has met with his oncologist who is also a hematologist and he released him from the hospital so he should be on the way home. He'll be taking clumaden (sp?) blood thinner and will give himself injections of an anti coagulant for a while.

Thank you for all the prayers, everyone. They are deeply appreciated. I've been visiting with my mom and she is worried this will happen again and he won't be so lucky. She's not typically a woman to borrow trouble but I think she's become more of a worrier as she gets older.

Alert:

Trent Lott and Senator Frist are furious at the Democrats who just went into secret, closed session to discuss pre war intelligence and the Libby indictment.

Lott said that has NEVER been done without appropriate notice to the other side. He called it a stunt. And Frist is VERY angry and says it's an afront and never been done before.

This is the beginning of the left talking about impeachment, imo.

Below is a note from a friend in Colorado. She had breast cancer in 2000 and has been on many drugs. There are some severe problems with this drug plan. I learned a little more today and will post when I have definitive answers. Right now....the people trying to implement the program aren't really sure about some very important items. What a MESS!!!!

"Hi Bev: All that I have seen of Mr. Bushes medicare prescrip. plan so far only means that I will be paying dearly for my scripts from now on, as I have been on Patient Assistance programs with several of the drug companies and that will all end the first of the year. So with $250.00 deductable, and the fact that they will only cover the first $2300. of your scripts and after that we have to pay all of the cost it will cost me about $500. per month, so told R I will just quit taking all but my two heart pills and to heck with the rest. He feels that I am greatly over-medicated anyway, and perhaps his is right, who really knows."

Hi, bev. I'm sad to say that the Medicaid prescription plan is a mess. We taxpayers are bribing companies NOT to drop their retirees, but the number crunchers can play the numbers and find out they are better dropping people and knowing the government will pick them up.

I personally know about a dozen retiree families, including my dad, whose companies have dropped them from coverage as of 1/1/06. And they will all pay far more than they were paying under their retirement plans. AND, we taxpayers are going to pay far more.

It's one of the worst bills that's been passed in many years.

It is a mess!!! I heard (from a Medicare rep) that there is a senator from MN? maybe - he didn't know his name, but said the senator was trying to get this whole mess set aside until "reasonable minds" could take a look at it. Does anyone know who he is talking about?

I personally can't believe our President signed this bill in its final form, because unless I am not understanding it at all, it is a disaster!

It's a disaster alright. So many former Republicans, citizens and elderly, are very, very angry. It's going to cost them thousands and thousands of dollars more a year. For example, my dad is on 9 pills a day because of a stroke he had a few years ago.

It's won't bankrupt them, but it's not going to be pretty either.

I'm sorry, bev, but I don't know the Senator in MN. We've written letters about it and so have some other folks I know, but we're not terribly hopeful that something will change.

Here is "my day" to fill you in on my "exciting" life :-)

:Hi all: I am home - I went in very early this morning - caught up on my own work, then over to the care center for beauty shop, back to the clinic for a half hour, then back to the CC to pass trays for lunch. At 1:00 p.m. I went to the patient/provider area of the clinic to start learning the layout of the treatment rooms, procedures, etc. I have that down pretty well....so, tomorrow when Dr. Walzcak begins her first day, she can tell me how she wants her patients handled, the routine she wants followed, etc. Hopefully, they will get a nurse hired for her SOON, I don't mind helping, but I like to put in 6 to 7 hours and then get home before 2 p.m. so I can spend some time with my critters and doing things around the house. Until they get someone, I will be getting home after 5:30/6:00 p.m each day.

I am anxious to start painting the new entry way! However, even if I had all the time in the world, the weather is stopping me right now. We had 3.14" of rain between midnight and 5:00 a.m. this morning - it has rained most of the day, although it is not raining right now. The weather man says we will have a storm move ashore tomorrow with significant rain AND the dreaded wind. The river is fat but still in its banks - but, you can tell it has gone into places where it shouldn't have :-) I just saw some cut logs float by and there is a lot of debris that we don't normally see. Laurie's creek was really high last night - it will no doubt get as high as her creek-side patio by tomorrow afternoon.

It isn't cold but it is damp and cool enough that a fire feels good. I have kept a small fire going since Sunday and it is cozy. I have the power sources charged and the candles ready just in case the wind blows the lights out.
