Attorney firings had genesis in White House (serving at the pleasure of the President)

The White House suggested two years ago that the Justice Department fire all 93 U.S. attorneys, a proposal that eventually resulted in the dismissals of eight prosecutors last year, according to e-mails and internal documents that the administration will provide to Congress today.

The dismissals took place after President Bush told Attorney General Alberto R. Gonzales that he had received complaints that some prosecutors had not energetically pursued voter-fraud investigations, according to White House spokeswoman Dana Perino.

Gonzales approved the idea of firing a smaller group of U.S. attorneys shortly after taking office in February 2005. The Gonzales aide in charge of the dismissals — his chief of staff, D. Kyle Sampson — resigned yesterday, officials said, after acknowledging that he did not tell Justice officials about the extent of his communications with the White House, leading them to provide incomplete information to Congress.

King County prosecutors are investigating apparent voter-registration fraud in the 2006 general election.

Dan Satterberg, chief deputy to King County Prosecutor Norm Maleng, confirmed late Thursday that attorneys from his office will meet later this week to brief their federal counterparts regarding evidence that hundreds of voter-registration cards submitted in King County were forged.

Satterberg said “there are significant irregularities” among a batch of more than 1,800 voter-registration cards submitted to the county by canvassers for the Association of Community Organizations for Reform Now (ACORN), a national group that represents the interests of low- and moderate-income citizens.

County prosecutors, aided by King County sheriff’s investigators, have been looking into the allegations of forgery since election officials noticed that hundreds of the cards submitted by ACORN canvassers appeared to be in the same handwriting.

INDIANAPOLIS — A day after five Marion County precincts failed to open for Tuesday’s primary election, the county’s clerk said she would welcome efforts to seek a revote in those precincts.

As many as 100 of the county’s 917 precincts failed to open as scheduled at 6 a.m. Tuesday, and five precincts — where about 3,100 people are registered to vote — never opened Tuesday. White about 150 inspectors — the people legally required to open polling places — failed to show for duty as scheduled.

Because people must vote at their own precinct, the people belonging to the five closed precincts couldn’t vote Tuesday.

Two former election workers pleaded no contest Monday to rigging a recount of the 2004 presidential election to avoid a longer, more expensive hand recount of all votes.

Cuyahoga County election workers Jacqueline Maiden, 60, and Kathleen Dreamer, 41, pleaded no contest to negligent misconduct and failure to perform official duties, prosecutors said.

The White House wanted any applicants for citizenship to be naturalized in time to register for the November election, so the pressure on the INS was constant.

49,000 questionable names found on voter rolls

AUSTIN — State auditors found more than 49,000 potentially ineligible felons and dead people on Texas voter rolls this year, but did not find that any cast ballots in May’s special election.

The audit report released Tuesday said that there may be even more potentially inaccurate voter information but they were unable to check for U.S. citizenship status or federal felony convictions or verify records that lacked a Social Security number and Texas driver’s license number.

The audit recommended that the Secretary of State’s Office do a better job of matching criminal conviction and death records with the voter list.

The potential for fraud is not trivial, as federal privacy laws prevent cross-checking voter registration rolls with immigration records. Nevertheless, a 1997 Congressional investigation found that “4,023 illegal voters possibly cast ballots in [a] disputed House election” in California. After 9/11, the Justice Department found that eight of the 19 hijackers were registered to vote.

Under pressure from liberal groups, some states have even abandoned the requirement that people check a citizenship box to be put on the voter rolls. Iowa has told local registrars they should register people even if they leave the citizenship box blank. Maryland officials wave illegal immigrants through the registration process, prompting a Justice Department letter warning they may be helping people violate federal law.
