I need advice--have run out of ideas and my spirit is broken *vanity*

I thought the same thing, either here, or some other site that uses the same terms.

If this is a legit post I apologize for saying ZOT, but sumthin' smells....a hot political topic, President Bush is getting blamed for what happened, etc., and she posts her question to a conservative site, instead of contacting a lawyer, which money or not, she does have access to?

I am just now getting some of my October mail. I never expected an Express package with a tracking number could get lost.
I DO have a letter from Consumer Affairs confirming the fact that this has happened.

The landlord might just be protecting his rights under the lease agreement. If you signed a lease agreement with the landlord (Lessor)and that agreement has no specified grace period (late payment), then if the Lessor accepts a late payment, the lease agreement now has an implied grace period. The landlord then loses certain timely eviction rights if you fail to pay in a timely fashion in the future.

This may not be the problem and is just speculation, because I don't know your specific circumstances, but, if the above is part of the problem, you can always affirm in writing that the lease agreement will not be altered by your late payment.

It's probably because the landlord has tenants that will pay more. Lot of that going on.

I lived in Lakeview. I'm now living in Lafayette. A great town. As a landlord in the past, I had to give a tenant 30 days notice to vacate. That's why one collects both the first and last months rent for a tenant to move in. Perhaps there are some interim laws enacted due to the disaster. There was a temporary moratorium on evictions right after the disaster. But they expired.

So I don't understand how your 24 hour eviction is possible. PM me if you would like to talk. Maybe I can be of some help. I'm in a FEMA trailer in Lafayette.

The Brief, for the Short Attention Span Theater:

1. She has a job

2. Checks were supposed to be direct deposited...didn't happen.

3.Missed 2 paychecks due to trouble with direct deposit.

4. Checks were express mailed to her, but lost.

5. Rent late, but ok. Landlord tells her to wire rent.

6. Wire does not go thru

7. Landlord now won't accept her rent.

8. She has the money

9. She has a job

10. Please read # 1, 8,9 again. Hey, how do you all get those big feet in your mouths anyway?

The last time my postmaster took responsibility, he told me to make the check out to "USPS", and I stormed out of there yelling "That's the last time I go postal!!".

I understand that, but what good is this job if you're not getting paid for it, or not getting the money when you need it? That's kind of my whole point--you can sit there and say "But I have a job!" but if you're not getting paid, what good is it? Are you going to sit in the street and say "But I have a job!" or are you going to get a temp job where you get paid--some even pay that day--to pay your bills NOW or get a place NOW?

I have contacted a lawyer--most have left town and I couldn't find one available for today. I just notice Friday that this was happening.
I just got a call and have one that will help me with the appeal. It just doesn't seem right that he can refuse the rent even though i have tried to pay him. It WAS late, but there was absolutely nothing I could do about it. I had a very large anount of money tied up in those checks coming to me. I spent alot moving back here. I was out of work temporarily and don't have a slush fund. i am not a freeloader--this has all been my OWN money.

It does not matter if you believe her, you didn't read it. If you had, you would realize that your post made no sense whatsoever.

This happens too often on this site, and it's a bit irritating to me every so often. Read the post before commenting on it, then I'll be happy.

P.S. I find your whole post odd, but the part about suing the post office makes me suspicious. As I stated, it all depends on your agreement with the landlord--if you agreed to pay by a certain day and didn't, he has every right to toss you, so why are you seeking to sue the post office?

If you need money, get a temp job. If you don't need money, why are you asking how to sue?

She does not have the money because the eeeevil USPS is keeping it from her.

I don't need a lecture from someone who needs every point explained to them. She's complaining about not having the money, so I suggested a TEMP job, can you read, TEMP to alleviate her current situation.

Go lecture someone about reading once you've learned to read yourself.

If this is for real...

For those crying foul. So many apartments and all were lost in the storm that its not a problem of getting a job in New Orleans, there is simply nowhere to live if your house or apartment was destroyed. I have one brother who has now moved to North Louisiana for good. I am in the process of moving to Georgia while relatives that lost their home use mine there. In fact the industries that New Orleans depends on is in trouble because while good paying service industry jobs are available (I saw $12 per hour at Burger King with a $600 signing bonus) there is no place for them to live!

I was missing a VA disability check for 3 months, I finally got it last week. Mail in New ORleans is still screwed up. My mother gets mail in fits and spurts, sometimes she gets mail that is 6 months old, sometimes it was mailed yesterday.

Apartment owners in New Orleans area who still have livable properties can and are breaking leases for any little reason to jack up the prices. Apparently it is pretty much legal there for them to do it.

If you really are a Lakeview girl I can sympathize, my aunt lost her home there, 50 years of stuff and memories were washed away. Good luck in your fight, but I am afraid in Louisiana the landlord has the upper hand.
