Duke Rape Case Defense: Throw Out DA Nifong and Photo ID

Accused Duke lacrosse player Reade Seligmann's attorneys want Durham County District Attorney Mike Nifong thrown off the case.
Today, they filed a legal motion specifically asking for it.
"DA Mike Nifong neglected his duty as a prosecutor to seek the truth and a fair prosecution," the defense's motion reads.
The motions were filed just 24 hours before Nifong's Tuesday election in which he's fighting to keep his seat. Nifong is being challenged by former prosecutor Freda Black and private lawyer Keith Bishop

On Friday, Finnerty's attorneys filed a request for evidence that investigators have collected in the case. Like a similar filing made earlier by Seligmann's attorney, the document included a request for information on any inconsistent statements made by potential witnesses.

[AV], the Raleigh, NC stripper claiming she was raped by Duke lacrosse players, lied about the incident when she faced arrest for violating her probation, and feared lsing her two children to the Dept.of Social Services.

Durham, N.C. -- Members of the Duke University mens lacrosse team are academically and athletically responsible students who were not out of control before their party of March 13, but too many have been irresponsible in their use of alcohol and engaged in repetitive misconduct, a faculty committee that carried out a comprehensive review of the team reported Monday to Duke President Richard H. Brodhead.

Another committee, which reviewed Dukes judicial practices for students, said inconsistent enforcement of the universitys alcohol policy severely undermines its effectiveness. Dukes judicial policies are quite comprehensive and reasonable for dealing with students facing criminal charges, but students need clearer expectations to guide their behavior outside the classroom and in the community, the committee said.
